HVACNext Terms of Service

HVACNext provides informational reports for HVAC businesses and homeowners.

Business Competitive Reports help HVAC businesses understand their local markets, customer feedback, competitors, market visibility, and opportunities for improvement.

Homeowner Comparison Reports help consumers research and compare HVAC companies advertising services in their area.

Reports may include analysis of:

• Publicly available customer reviews and ratings.
• HVAC businesses and their services.
• Business websites, promotions, financing, warranties, and advertised offers.
• Customer experience comparisons and review summaries.
• Local market visibility and competitive positioning, where applicable.
• Business improvement recommendations, where applicable.

Reports are generated using automated data collection, analytical software, and artificial intelligence.

HVACNext is an independent research service, not a contractor referral or lead-generation service. We do not arrange contractor appointments or share homeowner contact information with HVAC contractors for sales outreach.

HVACNext relies on publicly available information and third-party sources that may be incomplete, inaccurate, outdated, or unavailable.

We make reasonable efforts to produce useful reports, but we do not guarantee that:

• Every HVAC business serving a particular area will be identified or included.
• Every customer review, service, promotion, discount, warranty, financing offer, or maintenance plan will be discovered or included.
• Automated website analysis will successfully access or examine every relevant page.
• Third-party information or AI-generated analysis will be complete, accurate, or error-free.
• Advertised prices, offers, terms, or service availability will remain unchanged.
• A business included in a homeowner report will serve a particular property.
• Business recommendations will produce specific financial or operational results.

Website restrictions, changing content, incomplete navigation, third-party data limitations, and automated analysis may cause information to be missed or incorrectly interpreted.

The absence of an offer, service, or benefit from a report does not establish that a company does not provide it.

Homeowners should independently verify contractor qualifications, service availability, pricing, financing terms, warranties, and promotional eligibility before hiring a contractor.

Inclusion in a report does not constitute an endorsement, certification, or guarantee of any contractor's qualifications, performance, or suitability.

HVACNext reports are informational research tools. Business customers are responsible for evaluating recommendations before making business decisions.

The purchase price is displayed before checkout.

When you place an order, HVACNext may request a temporary authorization for the purchase amount through Stripe.

You will only be charged if HVACNext successfully completes your report.

An authorization is not a completed charge. Your bank or card issuer may temporarily display the authorized amount as a pending transaction.

If HVACNext cannot successfully complete the report, we will cancel the authorization. The timing of the release of pending funds is determined by your card issuer.

If an authorization expires before report completion, we may request a new authorization before continuing. We will not initiate an additional charge without an appropriate payment authorization.

HVACNext applies qualification criteria to identify HVAC businesses with sufficient relevant information for meaningful comparisons.

Businesses may provide HVAC services exclusively or alongside plumbing, electrical, or other services. HVACNext uses available evidence to evaluate business eligibility and distinguish relevant customer experiences from those clearly involving unrelated services.

If insufficient businesses qualify, we may be unable to complete a report. In that event, you will not be charged.

Where a reduced-size report is offered, you may either:

• Approve the smaller report and continue with the purchase.
• Decline the smaller report and cancel without a completed charge.

A report containing fewer businesses may provide a less representative comparison of the overall local market.

Completed reports are made available through your HVACNext account.

Reports are generated for a specific business or homeowner service area and reporting period. Because they are customized digital products, completed and successfully delivered reports are generally nonrefundable, except as described below or required by applicable law.

We will refund the purchase price if:

• A technical defect prevents you from accessing a successfully completed report and we cannot correct it within a reasonable time.
• You were charged more than once for the same report.
• We charged you without a valid payment authorization.
• The report was not successfully delivered.

Refund requests should be submitted to support@hvacnext.online within 30 days of delivery or attempted delivery.

Nothing in these Terms limits any refund, cancellation, or other consumer rights required by applicable law.

You agree to provide accurate account information, maintain the security of your account, and use HVACNext lawfully.

You may use purchased reports for your own personal or internal business purposes, as applicable.

You may not resell, redistribute commercially, or present HVACNext's proprietary reports as your own commercial reporting product without written permission.

HVACNext retains ownership of its software, report templates, proprietary analytical methods, branding, and original report presentation.

Upon successful payment, you receive a nonexclusive license to download, retain, and use your completed report for personal or internal business purposes, as applicable.

Information originating from third parties remains subject to applicable rights and restrictions.

Certain report findings, summaries, and recommendations may be generated or assisted by artificial intelligence.

AI-assisted analysis may summarize, classify, interpret, or compare information from third-party sources. Such analysis can omit relevant information or misinterpret source material and should not be treated as independently verified professional advice.

AI-generated content can contain errors or unsupported conclusions. You are responsible for independently evaluating report findings before relying on them for significant personal, business, or financial decisions.

We may modify our service, data sources, report features, qualification criteria, and pricing.

Changes to pricing will not retroactively alter the agreed price of an existing order.

We do not guarantee uninterrupted service or continued availability of every third-party data source.

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.

HVACNext does not warrant that reports will be complete, accurate, error-free, or suitable for any particular personal, commercial, or business purpose. Section 2 describes specific limitations on report content. No advice or information obtained from HVACNext creates any warranty not expressly stated in these Terms.

Nothing in this section excludes warranties that cannot legally be excluded.

To the extent permitted by applicable law, HVACNext and ASB Consulting will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of our service.

To the extent permitted by applicable law, our aggregate liability relating to a purchased report will not exceed the amount paid for that report.

Nothing in this section excludes or limits liability that cannot legally be excluded or limited.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles.

Before filing a claim, you agree to first contact us at support@hvacnext.online and give us 30 days to resolve the issue informally. Most concerns can be resolved quickly this way.

Any dispute that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Fulton County, Georgia, or, if you prefer and the rules permit, by video or telephone hearing. The arbitrator may award the same individual relief a court could, but only in your individual capacity.

You and HVACNext each agree that claims will be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims without the written consent of both parties.

Either party may bring an individual claim in small claims court if it qualifies and is brought in the county where you live or in Fulton County, Georgia.

Claims regarding HVACNext's intellectual property (including its trademarks, software, templates, and report content) may instead be brought in the state or federal courts located in Fulton County, Georgia, and you consent to their jurisdiction.

Nothing in this section limits any right you have to file a complaint with a government agency, or any non-waivable consumer protection rights under applicable law.

Our handling of personal information is described in our separate Privacy Policy.

Payment card information is processed by Stripe. HVACNext does not require customers to provide their complete payment card numbers directly to our application.

We may update these Terms periodically.

The version accepted when you place an order will govern that order, unless otherwise required by law.
